Personal Injury Questions & Answers

How do I know if I have a personal injury case?

First, you must have suffered an injury to your person or property. Second, you should consider whether your injury was someone else's fault. It is not always necessary to have a physical injury to bring a personal injury lawsuit. Some personal injury claims could be based on a variety of nonphysical losses and harms. In the case of an assault, for example, you do not need to show that a person's action caused you actual physical harm, but only that you expected some harm to come to you. You also may have a case if someone has attacked your reputation, invaded your privacy, or inflicted emotional distress upon you

Is there a time limit for when I can file a Personal Injury claim in Rhode Island?

Yes there is. In Rhode Island, the statute of limitations for filing a Personal Injury case is 3 years. If a person is under the age of eighteen, they have until 3 years of reaching the age of eighteen to file.

How often do Rhode Island Personal Injury cases actually make it to court?

Some Rhode Island Personal Injury cases make it to court, but quite often they do not. The answer sometimes lies with you, the client. Early in the process the Rhode Island Judiciary will encourage the attorneys on both sides of a Personal Injury case to assess how much money they think is fair to compensate the injured person for his injuries. It is often up to you and your family to decide whether to take this 'early offer' of money, or the pursue the case through the courts.
